In the Judge Loya death case, Supreme Court said that there is no other reason to disbelieve the Judicial Officers in and declared that investigation reveals that he died of natural causes. "Amit Shah was discharged in the case", Jaitley said.
The Congress also dared the government to order an independent investigation and asked why it was shying away from it if judge Loya's death was natural. "It is the court's duty to protect law".
The SC judgement remarked that the PIL was politically motivated and it has an intention to demean the Court, Biren said. He wrote, "The four judges of the Supreme Court who held the controversial Press Conference are all experienced judges and in my view men of high integrity".
In the strongly-worded blog, Jaitley, who is also a renowned Supreme Court lawyer, called the judge Brijgopal Harkishan Loya death case an instance "that nearly created a judicial mutiny". This move, the petitioner says, is in contravention of Para 22 of the Memorandum of Procedure which says, "the Chief Justice of the High Court, however, should not make a recommendation of the appointment of an Additional Judge when a vacancy of permanent judge is available in that High Court".
It had come down heavily on alleged accusations, bullying of judges in the top court by some activist lawyers in the Loya case and said that the judiciary and judicial officers need to be saved from such averments. The Finance Minister argued that BJP president Amit Shah "had no role in (the) Sohrabuddin Case. It has exposed the dirty design of the Congress and Rahul Gandhi should apologise to the country", he told reporters.
Observing that PILs have "developed as a powerful tool to espouse the cause of the marginalised and oppressed", Chief Justice Dipak Misra, Justice AM Khanwilkar and Justice DY Chandrachud said it was being brazenly mis-utilised by persons with a personal agenda and to settle business and political rivalries. Party spokesperson Randeep Surjewala said it is unfortunate that the death of a judge is a matter for celebration for the BJP.
Maharashtra Chief Minister Devendra Fadnavis demanded an apology from Rahul Gandhi, Communist leaders and media houses for "attempting to malign" Shah's image.
